By using the Website, placing an order, initiating an FFL transfer, or otherwise engaging our
Services, you (“Customer,” “you,” or “your”) agree to these Terms & Conditions (“Terms” or the
“Agreement”) and all Policies incorporated by reference.
1. Introduction and Acceptance of Terms
1.1 These Terms govern all transactions, sales, transfers, shipments, deliveries, services, communications, and other interactions conducted by Faith First Firearms through the Website, authorized platforms, and affiliated partners (collectively, the “Services”).
1.2 If you do not agree to these Terms, do not access the Website or use the Services.
1.3 These Terms incorporate by reference all Policies posted or linked on the Website.
1.4 Processing of personal information is governed by our Privacy Policy. In cases of conflict, applicable law controls.
2. Purpose and Scope
2.1 These Terms apply to all firearm, ammunition, and accessory orders; FFL transfers; shipments; returns; communications; storage; abandonment; and disputes arising from such activities.
2.2 We operate in accordance with federal and Texas law, including the Gun Control Act of 1968 and ATF regulations.
2.3 Any unenforceable clause shall be interpreted to preserve legal effect while maintaining the parties’ original intent.
3. Definitions
The following definitions apply:
- “FFL”: A Federal Firearms Licensee authorized under 27 C.F.R. Part 478/479.
- “Transfer”: Lawful delivery of a firearm via an FFL after background check completion.
- “Firearm”: As defined under 18 U.S.C. § 921(a)(3).
- “Ammunition”: Cartridges, shells, or projectiles designed for firearms.
- “Accessory”: Non-regulated items including optics, magazines, gear, etc.
- “Transaction”: Any order, purchase, service request, or firearm transfer.
- “NICS”: The FBI National Instant Criminal Background Check System.
- “Business Day”: Monday–Friday, excluding federal holidays.
- “Abandonment Period”: 90 days after notice of availability for pickup.
- “NFA Item”: Items regulated under the National Firearms Act.
4. Customer Acknowledgment and Duty to Review
4.1 You acknowledge that you have read, understand, and accept all Terms and Policies.
4.2 You agree to review current Terms before each Transaction.
4.3 You are responsible for compliance with federal, state, and local laws.
5. Digital Commerce and Order Acceptance
5.1 We operate online and maintain no public retail showroom.
5.2 All orders are subject to identity, payment, and FFL verification.
5.3 Orders may be declined for fraud, prohibited products, mismatched billing, or unlawful intent.
5.4 Prices and availability may change; errors may be corrected at any time.
5.5 We process payments securely and do not store full payment-card data.
5.6 Improper chargebacks constitute breach of contract and may incur recovery fees.
6. Compliance with Law; Representations
6.1 We comply with federal and Texas law.
6.2 You represent that you are eligible to purchase firearms and will not engage in a straw purchase.
6.3 False statements or attempts to evade law will be reported to ATF.
7. State & Local Law; Restricted States and Products
7.1 Customer Responsibility for State & Local Compliance.
You are solely responsible for knowing and complying with all applicable laws regarding firearms, ammunition, magazines, and accessories. By placing an order, you certify that the item is legal in your jurisdiction.
7.2 Restricted States and Localities.
Certain jurisdictions impose additional restrictions on firearms, ammunition, “assault weapons,” magazine capacity, and NFA items, including but not limited to:
California, Colorado, Connecticut, Delaware, District of Columbia, Hawaii, Illinois, Maryland, Massachusetts, New Jersey, New York, Rhode Island, Vermont, Washington, and any locality with similar restrictions. We may restrict or cancel such orders at our discretion.
7.3 Ammunition and FFL/Vendor Requirements.
Some jurisdictions require ammunition to be shipped to an FFL or licensed vendor and may require permits or background checks. You agree to comply fully.
7.4 Refused, Illegal, or Non-Compliant Orders.
You are responsible for:
- all outbound shipping charges;
- all return shipping charges;
- FFL transfer fees;
- storage or administrative fees;
- restocking fees;
- any costs necessary to resolve non-compliance.
7.5 No Legal Advice.
Provided information is general guidance, not legal advice. You must verify legality.
8. Third-Party Links and Vendors
8.1 The Website may link to third-party platforms.
8.2 We are not responsible for third-party content or policies.
9. Manufacturer & NFA Compliance
9.1 NFA items require ATF approvals and taxes.
9.2 We will not ship NFA items until approval is complete.
9.3 You are responsible for verifying eligibility.
10. Firearm Sales & Transfer Requirements
10.1 Firearms must ship to verified FFLs.
10.2 You must confirm the FFL accepts transfers.
10.3 We ship only to ATF-verified FFL addresses.
10.4 If an FFL refuses delivery, you are responsible for all associated costs.
10.5 Firearms are released only after successful NICS check and Form 4473.
11. Background Check Policy
11.1 Transfers require a NICS check.
11.2 NICS outcomes include Proceed, Delay, or Deny.
11.3 Denied transfers may incur storage and abandonment procedures.
11.4 Faith First Firearms conducts all required background checks through the National Instant Criminal Background Check System (NICS) or the applicable Texas DPS portal. You must complete ATF Form 4473 in our presence prior to submission.
If NICS returns a “Proceed,” the firearm will be released at the appointment upon payment of all applicable fees.
If NICS returns a “Denied,” we cannot and will not transfer the firearm to you under any circumstances. Denied transfers are subject to our storage, return, and administrative fees outlined in our policies. Transfer fees are non-refundable.
If NICS returns a “Delayed,” we must wait for NICS to complete its review.
If no final determination (“Proceed” or “Denied”) is provided within five (5) business days, the transfer will be canceledin accordance with our internal compliance policy. In this case:
The firearm cannot be transferred to the customer
The transaction will be treated as a canceled transfer
All transfer and processing fees remain non-refundable
The firearm may be returned to the seller at the customer’s expense or handled under our Storage & Abandonment Policy
Customers wishing to challenge or appeal a NICS decision must contact the FBI directly. We cannot file, track, or expedite appeals on your behalf.
Faith First Firearms does not release any firearm without a confirmed NICS “Proceed.” We do not transfer firearms based on the federal Brady date or the expiration of the delay period.
11.5 NICS appeals must be filed directly with the FBI.
11.6 Records are retained per ATF requirements.
12. ATF Form 4473 Requirements
12.1 ATF Form 4473 must be completed at transfer.
12.2 Falsifying Form 4473 is a federal crime.
12.3 Records are retained for required periods.
13. Identification & Eligibility
13.1 Acceptable ID includes a driver’s license, state ID, passport, or military ID.
13.2 You must be 18+ for long guns and 21+ for handguns/receivers.
13.3 Straw purchases are prohibited.
14. Shipping & Receiving
14.1 Firearms ship only to FFLs.
14.2 Items shipped to us require prior authorization.
14.3 We are not liable for loss during transit.
14.4 Unauthorized returns are refused.
14.5 Return shipping fees and a $35 administrative fee apply to all returns, including denied NICS checks.
15. Online Sales, Payment Verification & Chargebacks
15.1 Orders with inconsistent information may be canceled.
15.2 Improper chargebacks may incur administrative and legal fees.
15.3 Firearm sales are final once shipped to an FFL.
16. Manufacturer Warranties & Third-Party Fulfillment
16.1 Warranties are provided by manufacturers.
16.2 Contact manufacturers for warranty claims.
16.3 We disclaim implied warranties.
16.4 We are not responsible for manufacturer defects.
17. Insurance and Risk of Loss
17.1 Risk of loss transfers once the carrier accepts shipment.
17.2 Optional insurance is available.
17.3 We are not liable for lost/stolen items after carrier acceptance.
18. Record Retention & Law Enforcement Cooperation
18.1 We maintain A&D and 4473 records.
18.2 Records may be inspected by ATF.
18.3 We cooperate with lawful investigations.
19. Communication Consent & Privacy
19.1 You consent to receive transactional communications.
19.2 You may unsubscribe from marketing messages at any time.
20. Intellectual Property
20.1 All Website content and logos are owned by us.
20.2 Unauthorized use is prohibited.
21. Transfer Fee Schedule
All fees are due before release of any firearm:
- Standard FFL Transfer: $35
- Active-Duty Military & Veterans: $25
- Law Enforcement, Fire & EMS: $25
- Texas License to Carry Holders: $30
- Church Security Team (verified): $25
- Additional Firearms (same order): $25 each
- Group Transfers (4+): discounted by written quote
- Return Shipment/Re-Transfer: $35 administrative plus shipping
22. Storage Policy
22.1 First 30 days: no charge.
22.2 After day 31: $10/day per firearm.
22.3 We are not liable for events outside our control.
22.4 Liability is limited to fair-market value.
23. Abandonment Policy
23.1 Items are considered abandoned after 90 days without transfer completion or appeal.
23.2 Notice is delivered when sent to your last provided contact.
23.3 After 90 days, items may be disposed of lawfully.
23.4 Storage, administrative, and shipping fees apply.
24. Returns & Refunds
24.1 Firearm sales are final after transfer.
24.2 Accessories may be returned in unused condition within 15 days.
24.3 Damaged items must be reported within 3 business days.
24.4 You are responsible for all shipping fees.
25. Customer Obligations
You agree to comply with all laws, provide accurate information, and securely store firearms.
26. Firearm Safety & Proper Use
26.1 Firearms are inherently dangerous; you assume all risks.
26.2 You agree to follow safety rules and manufacturer instructions.
26.3 Safety training is encouraged.
27. Assumption of Risk
You assume all risks associated with firearm possession and use.
28. Limitation of Liability
28.1 We are not liable for indirect or consequential damages.
28.2 Liability is limited to purchase price.
28.3 Limitations survive termination.
29. Indemnification
You agree to indemnify us for claims arising from misuse, false statements, or violations of law.
30. Warranty Disclaimer
30.1 Products are provided “AS IS.”
30.2 Manufacturer warranties apply.
30.3 We disclaim liability for modified products.
31. Force Majeure
We are not liable for events outside our control.
32. Dispute Resolution
32.1 Written notice and 90-day cure period required.
32.2 Mediation occurs in Williamson County.
32.3 Arbitration optional with mutual consent.
32.4 Litigation is last resort.
32.5 Class-action waivers apply.
33. Governing Law and Venue
Texas law governs; venue is Williamson County.
34. Severability
If any clause is invalid, the remainder stays in effect.
35. No Waiver
Failure to enforce terms is not a waiver of enforcement.
36. Assignment
You may not assign rights without permission; we may assign in normal business operations.
37. Survival
Key sections survive termination, including liability, indemnification, and dispute terms.
38. Export-Control Compliance
You must comply with ITAR/EAR export regulations.
